In the early morning of May 25, Huawei announced that it had filed an intellectual property lawsuit against Samsung in the North District Court of California and the Shenzhen Intermediate People's Court.
In its lawsuit, Huawei asked Samsung to compensate for its intellectual property infringement, which involved high-value patents for communications technology and software used by Samsung phones.
In accordance with established practice, companies generally negotiate intellectual property rights with the lawsuit company before initiating a lawsuit. If the parties cannot reach a consensus, they will sue to the court.
“Huawei has negotiated and cross-licensed with other patent holders in the industry for many years, and has signed licensing agreements with dozens of industry partners.†Huawei’s Intellectual Property Department Ding Jianxin said, “Huawei hopes that Samsung respects Huawei’s R&D and Intellectual property achievements, stopping patent infringement without permission."
According to Huawei's data, in 2015, Huawei's R&D investment in new technologies, new products and wireless communication standards reached 59.6 billion yuan (US$9.2 billion), accounting for 15% of sales revenue.
According to the number of international PCT patent applications published by the World Intellectual Property Organization (WIPO) in 2015, Huawei applied for 3,878 patents, an increase of 456 from the previous year. As of the end of 2015, Huawei has obtained a total of 50,377 patents granted worldwide, including patents such as LTE communications, smartphone operating systems, and user interfaces that are of high value to smartphones.
According to media reports, last year, Huawei and Apple reached a series of patent licensing agreements covering GSM, UMTS, LTE and other wireless communication technologies.
Previously, according to the newly released license registration information published by the State Intellectual Property Office, in 2015, Huawei licensed 769 patents to Apple, and Apple licensed 98 patents to Huawei. Huawei said that Huawei’s patent license to Apple is a fact, but the specific fees involve confidentiality agreements. Some insiders also estimate that Apple’s payment to Huawei last year was on the order of hundreds of millions of dollars.
However, the intellectual property war between the giants is also a common thing, which is a powerful weapon to suppress competitors.
Apple and Samsung have been in the global intellectual property war for many years, and Apple has filed an intellectual property lawsuit against HTC, another important competitor at the time.

At present, Samsung is still the largest smartphone shipment in the world and the boss of the Android camp.
On May 23, the report released by market research company Gartner showed that the global shipment of Samsung mobile phones in the first quarter of this year was 81.18 million, with a market share of 23.2%, a slight decrease from 24.1% in the same period of last year; Apple's mobile phone shipments were 51.62 million, the market share was 14.8%, a slight decline from 17.9% in the same period last year; Huawei ranked third, with shipments of 28.86 million and market share of 8.3%.
Samsung's shipments are the sum of Apple and Huawei. However, the top three Chinese companies are the only market share is rising.
